A child playing and getting hurt is one thing, but and injury due to broken equipment is not the child fault. The school and county should be aware of the situation and fix it as soon as possible. With something broken like that the school should not allow anyone on the equipment. The teachers should be aware of this as well to keep the students away to prevent injuries. The child's parents shouldn't be able to sue, but the equipment needs to be fixed as soon as possible and no one should be allowed on it until it is. I would say yes the school is responsible for the injury. Teachers can not be held accountable for what students do outside of the classroom, however they should always be monitoring student while on campus as part of their responsibilities as that school's employee. The equipment should be repaired. The person in charge of reviewing the safety of the playground equipment should complete a series of retraining exercises.
