  Case: Kindergarten student received a broken arm
During supervised playtime, prior to school starting in the morning a kindergarten student received a broken arm when she fell 12 feet due to a broken step on the playground equipment. Can the teacher, school, or district be held liable for the student's injuries?
Solution: (Rates are posted for this solution!)
Even though the injury occurred before school hours it was still on school property and caused by faulty equipment. I would say yes the school is responsible for the injury. Teachers can not be held accountable for what students do outside of the classroom, however they should always be monitoring student while on campus as part of their responsibilities as that school's employee.

Comments: I agree with this solution. It is our responsibility as school employees to monitor the students on campus. The only question I have is, was the child being supervised by a school employee or by their parent?

Comments: I agree with this solution because the teacher couldn't be held responsible for an injury that she isn't in charge of. If the teacher wasn't aware of the faulty equipment it isn't her fault. However, it is the school responsibility on the upkeep of the school grounds.
