  Case: Biting
If a student is biting other students in class, what and how am I legally supposed to interfere? At the time of the biting the student may hold on to other students with his teeth and I do not want to get in trouble by having to physically take the child off of the other student. Any recommendations that are law abiding and will get the issue fixed at the time of the incident before the bite goes far enough to brake skin.

I feel like you would be morally worse off not interfering than you would be legally by interfering. I would never be afraid to lose my job for helping a student who is in danger. Bite marks by any animal can be infectious.

Never stand by.

Contact administration, parents, social workers, psychologists, and outside sources if you have to. The school can be held liable if a student ends up in the hospital.

Comments: I would do exactly this. Even if I weren't CPI trained, I'm not going to stand by and allow a child to be harmed by another child. I would have to intervene.

Comments: This is a bad solution because you cannot legally restrain a child. You WILL lose your job and face consequences.

Comments: Yes morally it's wrong to watch but legal issues is what really get you into trouble. There are other ways of dealing with this

Comments: This is not something I would do. You cannot restrain the student. There are steps and procedures you should follow in the school that will help you manage this situation better.

Comments: While you have to be careful about touching, if another student is getting attacked I'm going to separate them physically. There is no way I could watch them attack another and just be like "be right back, I'm going to get someone that can pull him off you Jim"

Comments: I don't feel that it is quite appropriate to lose our jobs to stop a behavior such as this. While the behavior needs to stop, getting physical is not the way to deal with this.
