  Case: Everyone should be treated equal
Why are ESE children place in general education classes if they cannot be disciplined like the general education students. They fought for the right to be treated equal and not to be viewed as different, yet they can do bodily harm to others with no consequences. I watched a student physical destroy a classroom, spit on the teacher and kick another student in the face and all that happened is she was redirected and asked to calm down. A general education student does the same thing and gets three days suspension. Why are they not given the same consequences?

I would start by analyzing that student's IEP or 504, to see if there are clear instructions for handling these situations. I would then consult the school administration and talk to them about this issue.

Comments: I would do exactly this. Generally students that are ESE have a behavioral plan that the teachers have to abide by, which can be frustrating but analyzing the plan and talking to a higher up would help.

Comments: These documents should be the first place to go to whenever arguing that an ESE student needs some sort of punishment or making a comment about how an ESE student's plan is different.

Comments: This is the best course of action in this situation. Every student has different consequences because what works for Jessie has a negative effect on Bob.

Comments: I agree that getting to know your student's IEP and following the strategies outlined may help in controlling misbehaviors. Also a strong behavior management plan needs to be developed and implemented.

Comments: I entirely agree with the plan, however I would modifier my own behaviors according to the IEP/504.

Comments: Yes, I agree this is the best solution. It is a tough situation but ESE students are not really ever given the same consequence. This solution follows best course of action.
