What do I do with a 5th grade student caught stealing an ipod of another student?

Stealing is a touchy subject because lots of proof is required in order to make an accurate accusation. If in fact the student was caught stealing, that student should immediately sent to the office for administration punishment being that it is probably a school rule but also instruct the students to have them put them names on everything that belongs to them to prevent this or wrong accusations. I would then send a letter home to the child who stole about the classroom behavior. Also a letter to the rest of the parents instructing them to put their childs name on their belongings and informative to the happenings in the class that day.
