  Case: Private tutoring
You are a well-respected 5th grade teacher. The parents of a 4th grade student (not one of your students) comes to you and ask if you would tutor their son for the academic year. They will pay you $30 per hour and ask for 10 hours of tutoring to be done per week (two hours per day after school). They tell you that their son has been clinically diagnosed with a learning disability, but they refuse to believe the diagnosis. They state that their son "is lazy and needs the kind of accountability that his current teacher is not providing." You could use the money, but are concerned about the ethics of accepting such a position. What legal and ethical considerations need to be analyzed prior to you making a decision?

This is a tricky situation. If the teacher does decide that they will tutor the student, it would be best to do the tutoring in another place such as a public library. Accepting money from a parent for tutoring definitely could not be done at the school. I would also talk to the child's teacher and make sure that you will not be stepping on anyone's toes.

Comments: This is a suitable solution. Tutoring outside the classroom would be fine and get paid. Or tutor during school without getting paid for the better good of the child. I think clarification needs to be made on the diagnosis of the student.

Comments: This solution is somewhat acceptable but I think this teacher needs to read about the conflict of interest laws in order to make a decision.

Comments: Even if they ask the teacher if it is ok and tutor off campus, you would still have to make sure it is ok with the school to be paid for tutoring a student off campus and they are not your student.

Comments: I would contact the principal or human resources and see if this would be a problem or violate and codes.

Comments: This still seems a little tricky to me. I think that the teacher should talk to someone in administration before going through with this deal.

Comments: I do not agree with this solution. There is no legal or ethical considerations listed here. The child has been diagnosed with a learning disability and may need some special education. Are you capable of providing exactly what the child needs? Also legally I do not think it is a good move.

Comments: I think it would be important to talk to the administration first to make sure it is okay, and the other teacher to be professional and respectful.

Comments: I don't believe there is anything wrong with a teacher accepting money to tutor a student who is not in their class. It would only be a problem if the student was in that teacher's class.

Comments: I agree that you should offer your help, but I do not believe you should accept the money in any shape or form. Taking the money is still wrong even if it is not on school grounds.
